YOURTRADER MEMBERSHIP TERMS AND CONDITIONS
This page (together with the documents referred to on it) tells you the terms of membership on which you may join Yourtrader (“we” or “us”). By applying for membership, you confirm that you have read these Terms and Conditions and that you agree to comply with them. If you do not agree to these Terms, you must not apply for membership. If you have any questions, please contact us using the details below.
1. Information about us
1.1 We are Vetted Limited, trading as Yourtrader, a company registered in England and Wales with company number 0420000. Our office coming soon. Our main trading address is coming soon. Our VAT number is 803 0000 02. We operate the website www.yourtrader.com.
2. Your membership
2.1 Our membership is open to trades and services businesses that meet our membership criteria. In applying for membership, you confirm that you meet these criteria. We will ask for references from your customers and may carry out background checks.
2.2 If we accept your application, we will confirm acceptance by sending you an email. This forms the contract between you and us for membership. The membership is personal to you, and you may not transfer or assign your membership to any other person or business without our written consent.
2.3 We reserve the right to refuse membership or renewal of membership at our absolute discretion.
3. What we provide
3.1 As part of your membership, we will:
- Provide a listing on www.yourtrader.com for your business, including details of the services you offer, your contact details, and any feedback we have received from your customers.
- Provide marketing materials to you, such as stickers and logos, which you may use to promote your membership of Yourtrader.
- Provide access to our member portal where you can manage your listing, feedback, and account details.
- Provide support and advice in relation to your membership.
3.2 We may change the features and benefits of membership from time to time. If we make significant changes, we will notify you in advance.
4. Your obligations
4.1 You must:
- Provide accurate and up-to-date information to us at all times, including your contact details and the services you offer.
- Comply with any applicable laws, regulations, and codes of practice.
- Provide a high standard of service to your customers and deal with any complaints promptly and professionally.
- Only use the Yourtrader name and logo in accordance with our brand guidelines and not do anything that may damage our reputation.
4.2 You must not:
- Use the Yourtrader brand in any way that suggests we endorse your business or services beyond your membership.
- Engage in any conduct that could bring Yourtrader into disrepute or damage the goodwill associated with our brand.
- Provide false or misleading information about your business or services.
- Collect or harvest any personal data from the website or our members except as permitted by law and in accordance with our privacy policy.
5. Fees and payment
5.1 The membership fees will be as set out on our website or as notified to you when you apply or renew your membership. We may change our fees from time to time, but any changes will not affect your current membership period.
5.2 You must pay the membership fees in full and on time. If you do not, we may suspend or terminate your membership. We may charge interest on any overdue amount at the rate of 4% per year above the base rate of Barclays Bank plc, or the maximum rate allowed by law, whichever is lower.
5.3 If you cancel your membership or if we terminate it under clause 7, we will not refund any fees you have paid, unless required by law.
6. Feedback and complaints
6.1 We collect feedback from customers who use our website to find trades and services. We will publish this feedback on your listing, except where it is defamatory, offensive, or otherwise inappropriate, in which case we may remove or edit it.
6.2 If a customer makes a complaint about you, we may investigate it. If we find that you have breached these Terms or that you have provided poor service, we may take action against you, including suspending or terminating your membership.
7. Termination
7.1 You may cancel your membership at any time by giving us notice. Your membership will end at the end of your current membership period, unless we agree otherwise.
7.2 We may terminate your membership at any time if:
- You breach these Terms.
- You fail to meet our membership criteria.
- We believe that your continued membership could damage our reputation or the reputation of our other members.
- We cease to operate Yourtrader or we cease to offer membership.
7.3 On termination of your membership, you must immediately stop using any Yourtrader branding or marketing materials, remove any references to Yourtrader from your website and marketing materials, and stop describing yourself as a Yourtrader member.
8. Our liability
8.1 We will provide our services with reasonable skill and care, but we do not guarantee that our website or services will be uninterrupted, error-free, or secure.
8.2 We will not be liable to you for any loss of profits, business, goodwill, or any indirect or consequential loss arising out of or in connection with these Terms or your membership.
8.3 Our total liability to you under these Terms shall not exceed the total fees you have paid to us in the 12 months preceding the event giving rise to the liability.
8.4 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.
9. Changes to these Terms
9.1 We may revise these Terms from time to time. If we make significant changes, we will notify you in advance. By continuing to use your membership after the date on which the changes come into effect, you agree to be bound by the new Terms.
10. General
10.1 These Terms, together with any documents referred to in them, constitute the entire agreement between you and us in relation to your membership, and supersede any previous agreements.
10.2 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
10.3 We may transfer our rights and obligations under these Terms to another organization. You may not transfer your rights or obligations under these Terms without our written consent.
10.4 These Terms are governed by English law. Any dispute arising out of or in connection with these Terms or your membership shall be subject to the exclusive jurisdiction of the courts of England and Wales.
